Terms of Service

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you and Concepts.io LLC ("BAFware", "we", "us"). By creating an account or using the BAFware platform you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the platform.

2. The Service

BAFware provides AI-assisted competitive intelligence tools for founders and early-stage businesses. Features include competitor discovery, analysis briefs, monitoring alerts, and related capabilities. We reserve the right to modify, add, or remove features at any time with reasonable notice where practical.

3. Service Provided As-Is

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not guarantee that:

  • Analysis results are accurate, complete, or current.
  • The platform will be uninterrupted, error-free, or free of harmful components.
  • Any specific business outcome will result from use of the platform.

AI-generated content is inherently probabilistic and should be verified before making significant business decisions.

4. Accounts and Eligibility

  • You must be at least 18 years old and capable of entering a binding contract.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate registration information and keep it up to date.

5. Credits and Payment

  • Platform features consume credits. Credit balances and costs are displayed in the platform prior to use.
  • Credits are non-refundable except where required by applicable law or where a technical error on our part results in incorrect credit deduction.
  • Payments are processed by Stripe and subject to Stripe's terms. We do not store payment card information.
  • Prices are subject to change with 14 days' notice to existing users.

6. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of applicable laws.
  • Attempt to reverse-engineer, scrape, or extract data from the platform at scale.
  • Use the platform to generate content intended to harm, defame, or harass any individual or organisation.
  • Circumvent any rate limits, access controls, or billing mechanisms.
  • Resell or sublicense access to the platform without our written consent.

7. Your Data and Ownership

You retain full ownership of all data, content, and intellectual property you bring to or create within the platform. You grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the service to you. We do not claim ownership of your data and will not use it beyond what is described in our Privacy Policy.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONCEPTS.IO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Concepts.io LLC, its officers, employees, and contractors from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

Either party may terminate the agreement at any time. You may delete your account via account settings. We may suspend or terminate your account if you breach these Terms, with or without notice depending on the severity of the breach. Upon termination, your access to the platform ceases and any unused credits are forfeited.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance.
